The Supreme Court will begin hearing a case challenging the constitutionality of the central government's decision to bifurcate India's Jammu and Kashmir and withdraw special status. According to media reports, advocate Prashant Sen raised the matter in the bench of Chief Justice Lalit, Justice Indira Banerjee and Justice Ravindra Bhatt on Friday. He said the hearing of the case was supposed to begin after the summer vacation. But it is not listed yet. In response to this, the Chief Justice said that the hearing of the case will definitely start after the Durga Puja holiday.


On 5 August 2019, the Government of India revoked the special status granted to the state of Jammu and Kashmir under Article 370 of the Indian Constitution through a far-reaching constitutional measure. This article gave special status to the state. Soon after, the Indian government cut off communications there and arrested many political figures.


The then President of India, Ram Nath Kovind, issued a Presidential Order under the powers of Article 370 under the existing President's Order of 1954, abrogating all provisions of state autonomy. Home Minister Amit Shah introduced a reorganization bill in the Indian Parliament seeking to split the state into two Union Territories to be headed by a lieutenant governor.

The Bill was quickly passed in the Rajya Sabha with the support of regional parties before being presented in the Lok Sabha or Lower House the next day. As a result, restrictions on the purchase of property in Kashmir by residents of other Indian states were lifted. Besides, restrictions on Indians living in other states getting government jobs in Kashmir or permanently residing in Kashmir were also abolished.


At that time, the freedom fighters of Muslim-dominated Kashmir vowed to continue their struggle against such a decision of the Narendra Modi government.

International human rights organizations strongly condemn the move. Hindu nationalists, on the other hand, celebrate the event and claim that these steps will bring peace and investment in Kashmir.


At that time, several cases were filed challenging the decision of the central government. The last brief hearing was held on March 2, 2020. After two and a half years, the case is going to be heard again.
